These terms and conditions govern the use of the SWIFTIC ("the SWIFTIC"), an online ticketing platform managed and operated by KARUNA (SARAWAK) ENTERPRISE SDN BHD ("the Company") having its business address at No. 67, Lot 10210, 3rd floor, Jalan Tun Jugah, 93350 Kuching, Sarawak. By accessing and using SWIFTIC online platform (websites, mobile applications for Android, iPhone and iPad, Windows apps), you accept that you shall be bound by our current General Terms of Use ("General Terms") and Privacy Policy.
All tickets ("Tickets") are sold by SWIFTIC as ticketing agent for and on behalf of the entity or entities (collectively "Organiser") operating, managing, producing, promoting or providing including but not limited to live or recorded show, performance, screening, web stream, exhibition, conference, sporting event, cultural attraction or other product or service (individually and collectively, "Event", for which the Tickets are sold), or the venue, vehicle, craft, equipment, attraction, restaurant, web stream platform in or by which the Event are provided (individually and collectively, "Venue").
The services of SWIFTIC shall include enabling Organisers to collect payments from Ticket sales for Event registered on SWIFTIC from persons who want to attend such Events ("Visitors"). Organisers, Visitors, and third parties using our Services are all referred to in these General Terms collectively as "you" or "your". "SWIFTIC", "we", "us", or "our" refers to SWIFTIC and the Company including its respective directors, affiliates, agents, partners, and employees.
1.1. While SWIFTIC takes all reasonable care to ensure that tickets are correctly priced and only available for sale when intended, sometimes errors may occur. SWIFTIC may cancel an order made as a result of any such error, although in the case of a pricing/payment gateway error. SWIFTIC will endeavour to contact you to give you the option of purchasing the ticket at the correct price.
1.2. Each Ticket may also subject to any additional terms or provision of the Organiser for the particular event ("Organiser's Terms"). The Organiser's Term may differ from our General Terms and you hereby agree that these Organiser's Term shall apply to You in such an event, in addition to our General Terms
1.3. Where Organisers Terms are applicable, then our General Terms shall be read in conjunction with any applicable Organiser's Terms. If any terms and conditions contained in our General Terms conflict with any terms and conditions contained within the Organiser's Terms, then the Organiser's Terms shall prevail over our General Terms [and only to the extent necessary to resolve such conflict].
1.4. The Organiser's Terms may be disclosed as part of the event information on SWIFTIC's website or at the Organiser's website or any of its platform.
1.5. The Organiser reserves the right to add, withdraw, reschedule or substitute artists and/or vary advertised programs, prices, venues, seating arrangements (including ticket categories) and audience capacity.
1.6. Tickets may not, without the prior written consent of SWIFTIC and the Organiser, be resold or offered for resale at a premium (including via on-line auction or other unauthorized resale sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a Ticket is sold or used in breach of this condition, the Ticket may be cancelled without a refund.
2.1. SWIFTIC accepts payment via the following methods:
2.2. Full payment must be made for the ticket purchase at checkout. The payment will be deducted from your credit card account, debit card account e-wallet, or your bank account upon acceptance of your Order.
3.1. Only Tickets purchased through SWIFTIC will be honoured for a refund. SWIFTIC will not refund any Tickets purchased from unauthorised channels.
3.2. No refund will be made under any circumstances except pursuant to the conditions under Event Cancellation or Postponement.
3.3. SWIFTIC will only exercise the refund or exchange process under the instruction of the respective promoter/organiser if an event is cancelled, rescheduled or relocated by the Organiser.
3.4. You must apply for a refund within the reasonable time frame given by the respective Organiser. SWIFTIC will not entertain any refunds or exchanges as a result of a change in your personal circumstances.
3.5. If an event is cancelled, rescheduled or significantly relocated by the Organiser, all liability is limited to the amount for which the ticket was purchased following the refund policy set by the Organiser.
3.6. Proof of purchase must be submitted during your application for any refund or exchange. Only Tickets purchased through SWIFTIC will be honoured for a refund. SWIFTIC will not refund any Tickets purchased from other channels.
3.7. Refunds are subject to verification by the Company and may be denied if the request does not meet the eligibility criteria outlined in this policy.
3.8. Neither SWIFTIC nor the Organiser will be liable for any other losses incurred by you as a result of the cancellation, rescheduling or relocation of an event, including any travel and accommodation expenses.
3.9. SWIFTIC will only replace lost, stolen, damaged or destroyed tickets if the authenticity of the ticket can be verified, including proof of purchase, and if you give reasonable notice before the event. SWIFTIC may or may not charge a reasonable fee for the replacement of tickets. SWIFTIC may not replace tickets where seating is un-allocated (general admission tickets).
3.10. There will be a processing fee of 15% for refunds. Payment transaction fee and platform fees will be deducted before the refund is issued to the clients account. But do refine it
4.1. All Ticket, event information and dates on SWIFTIC are provided by the Organisers.
4.2. Any cancellation, postponement or alteration of any kind is the responsibility of the Organisers, and SWIFTIC disclaims any and all liability for any loss or damage suffered as a result of such cancellation, postponement or alteration.
4.3. Ticket Bearer is responsible to take note of any entry conditions and/or restrictions imposed on infants, children without tickets or any minimum admission age. Any purchaser below the age of 18 years of age is deemed to have parental consent before purchasing Ticket from SWIFTIC.
4.4. SWIFTIC may hold liable for prosecution any person who breaches any of the above T&Cs.
4.5. The Ticket Bearer voluntarily assumes all risk and danger incidental to the Services and Venue whether occurring prior to, during or subsequent to the actual Services or your presence at the Venue, including any death, personal injury, loss, damage or liability.
4.6. Unless cause by act of negligence or omittance of reasonable duty of care, SWIFTIC, its agents and employees shall not be liable for any death, personal injury), loss or damage however caused while in or using the Venue nor are they liable for any complaints, claims, refunds, or exchange for any reason whatsoever, including without limitation, those relating to the Event, or cancellation or postponement of the Event.
