Terms and Conditions for Ticketing Portal by Karuna (Sarawak) Enterprise Sdn Bhd on behalf of Hemisphere Corporation:

1.     Definitions

“Festivalgoers”            are individuals who purchase tickets and attend the festival.

“Ticketing Partner”      Ticketing Portal by Karuna (Sarawak) Enterprise Sdn Bhd on behalf of Hemisphere Corporation

“Organiser”                  Hemisphere Corporation

“Festival”                     Kuching Jazz Festival 2024

2.     Payment Gateway Fees

i.  An additional 2.5% payment gateway fee will be charged on the ticket.

3.     Refund

i. All refunds are subject to the deduction of the corresponding payment portal transaction charge, including cash, via the same payment mode. For the avoidance of doubt, all refunds shall be affected in the following manner, subject always to the term that the 2.5% payment gateway charges in favour of the Ticketing Partner for each ticket sold (and thereafter cancelled) are non-refundable:

ii. The ticket purchase is non-refundable under these terms and conditions.

a. There is no refund for the wrong festival, category, or/and wrong festivalgoer registered.

b. Ticket transfer only applies within the festival registered, where the festivalgoer wishes to transfer to another category (within the same event).

c. Refer to Paragraph 3. i.(b) There will be no refund of the ticket price difference if the transfer is made from a higher-priced ticket to a lower-priced ticket.

d. There is no refund if the festivalgoer cannot participate in the event.

4.     Festivalgoers (s) enter the festival entirely at their own risk.

i.  The Organiser and/or the Ticketing Partner shall not be liable for any injury or loss occurring as a result of participation in the festival (including, without limitation, any losses resulting from the Organiser’s and/or the Ticketing Partner’s negligence), provided that nothing in these terms and conditions shall exclude or limit the Organiser’s and/or the Ticketing Partner’s liability for death or personal injury resulting from the Organiser’s and/or the Ticketing Partner’s negligence or for any other type of liability that cannot be excluded or limited by law.

5.     Medical Conditions

i.  Should any medical or physical condition arise prior to the festival that is likely to affect the festivalgoer’s ability to attend, the festivalgoer should withdraw from the festival. The festivalgoer consents to any medical treatment being administered during the festival by official medically qualified personnel.

ii. The Organiser may prevent the festivalgoer from participating (either at the start or during the festival) if the Organiser or any medical representative considers that the festivalgoer should not participate for health and/or medical reasons.

6.     Ticket Validity

i.  Tickets purchased for the festival are valid only for the specified date(s) and event(s) as mentioned during the booking process.

7.     Ticket Transfer and Resale

i.  Ticket transfers are only permitted for tickets purchased and are subject to the organiser's approval. Purchases under Hotel Packages are not transferable.

ii. Ticket resale is strictly prohibited and may result in ticket cancellation without a refund.

8.     Festival Cancellation or Postponement

i.  In the event of the festival's cancellation or postponement, the Organizer will inform ticket holders about refund or transfer options.

9.     Event Entry Requirements

i.  Festivalgoers must comply with all entry requirements, rules, and regulations set forth by the Organiser and the venue.

ii. Festivalgoers must present valid identification and their tickets upon entry to the festival.

10.  Intellectual Property Rights

i.  All intellectual property rights, including but not limited to trademarks, logos, and event materials, belong to the Organiser. Participants are prohibited from using, reproducing, or distributing such materials without prior written consent from the Organiser.

11.  Data Protection and Privacy

i.  The Organiser may collect and process personal data provided by participants by applicable data protection laws. By purchasing a ticket and participating in the festival, festivalgoers consent to the Organiser's data processing practices as outlined in the Privacy Policy.

12.  Modification of Terms and Conditions

i.  The Organiser reserves the right to modify these Terms and Conditions without prior notice. Festivalgoers are advised to review them periodically for updates or changes.

ii. By purchasing a ticket and participating in the festival, festivalgoers agree to be bound by these Terms and Conditions. Failure to comply with these Terms and Conditions may result in denying entry to the festival or other appropriate actions the Organiser takes.

PRIVACY POLICY

The EVENT website is dedicated to protecting your privacy when you visit or communicate with our site or personnel. The Privacy Policy offered here, along with our terms of use offers an explanation regarding any personal data you may provide to us or that we garner from you. The Policy is changed occasionally to update you regarding any changes, so please make sure you review the Privacy Policy. Purchasing or pre-registering a Ticket to The EVENT implies that the customer has read, understood and agreed to accept the Privacy Policy below before attending the The EVENT.

All Ticket holders are subject to body/bag checks at all entry points into the Event grounds.

The Ticket holder grants the Event Organiser (and its assignees) the right to include the Ticket holder’s image, likeness, actions, and statements in any live or recorded audio, video, film, webcast, stream, or other transmission, exhibition, simulcast, or reproduction made of, or at, the Event in any medium or context for any purpose, including commercial or promotional purposes, without further authorization or otherwise.

The Event Organiser retains all webcast/Internet rights to the Event. Any live streams or broadcasts, whether for Internet or otherwise, from the Event must be specifically agreed to in advance with the Event Organiser. No one may transmit, broadcast, or communicate any live audio or audiovisual images from the Event site without the Event Organiser’s prior written permission. Even if you are a performer or sponsor, the broadcasting, displaying, or communicating any live audio or audiovisual images (whether for personal, commercial, or other use) is expressly prohibited, without the prior written permission of the Event Organiser.

Strictly NO professional photography, video and/or audio recording of any kind is allowed during the event.

Ticket holders may bring personal, non-commercial, photography devices into the Event and may use these devices to obtain short-form video and still photographs. For example, personal, non-commercial, photography and video devices include, but are not limited to, cell phones, small digital or film cameras (without a detachable lens).

No sponsorship, on site marketing, sampling, vending, coupon/product distribution, or other promotional/advertising activity may be conducted at the Event (inclusive of parking lots), absent the Event Organiser’s prior written approval in each instance.

The Event Organiser shall not have any liability to Ticket holders whatsoever for loss or expenses incurred in connection with the event or any cancellation of the event, including, without limitation, costs of any personal travel, accommodation or hospitality arrangements made relating to the event or the cancellation of the event.

DATA AND INFORMATION COLLECTED

Information regarding your visits to our website, any resources you used such as traffic data, location data, weblogs, and any communication data (these items are included, but not limited to those specified).

Forms filled out on our website allow us to collect information about you regarding registration or purchases you make.

Any data collected from communications to us from you, for any reason.
